Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the XploreR mobile application (“App”) or website (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

2. Description of Service

XploreR is a location-based treasure hunt platform that allows users to:

• Play outdoor quests involving navigation to real-world locations
• Complete challenges and missions at designated waypoints
• Track quest progress, statistics, and history
• Create quests for others to play (via the web platform)

3. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you must have permission from a parent or legal guardian.

4. Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized use of your account
• One person may register multiple devices but should maintain only one user account

5. Acceptable Use

You agree to use the Service responsibly and in compliance with all applicable laws. You must NOT:

5.1 Safety

• Use the App while driving, cycling, or operating any vehicle
• Enter private property, restricted areas, or dangerous locations while playing
• Ignore traffic signals, road signs, or other safety warnings
• Play in unsafe conditions (severe weather, darkness without visibility, etc.)
• Allow the App to distract you from your surroundings

5.2 Legal Compliance

• Violate any local, national, or international laws
• Trespass on private or restricted property
• Interfere with other people, businesses, or public spaces

5.3 Content & Conduct

• Upload offensive, illegal, harmful, or inappropriate content (including photos)
• Attempt to cheat, spoof GPS locations, or manipulate gameplay data
• Interfere with the Service's infrastructure or other users' experience
• Reverse-engineer, decompile, or disassemble the App
• Use the Service for commercial purposes without written permission

6. Location Services & Safety Warning

6.1 Location-Based Gameplay

The Service relies on GPS and location data to function. You acknowledge that:

• GPS accuracy varies and may not be precise in all environments
• Location data is collected during active gameplay (see our Privacy Policy)
• Background location tracking is used only during active quests and requires your explicit consent

6.2 Safety Disclaimer

XploreR does not guarantee the safety, accessibility, or legality of any locations featured in quests. Quest creators are responsible for selecting appropriate locations.

7. User-Generated Content

7.1 Quest Creation

If you create quests using the web platform:

• You are solely responsible for the content and locations in your quests
• You must ensure all waypoint locations are safe, legal, and publicly accessible
• You must not create quests that direct players to private property, dangerous areas, or inappropriate locations
• We reserve the right to remove any quest that violates these Terms

7.2 Photo Submissions

Photos taken during photo missions are uploaded to our servers. You retain ownership of your photos, grant us a limited license to store and display them within the Service, and must not upload photos containing illegal, offensive, or harmful content.

7.3 Reporting Content and Moderation

If you encounter a quest or review that is inappropriate, dangerous, misleading, or otherwise violates these Terms, you can report it directly in the app (“Report this quest” on the quest page) or by emailing privacy@xplorer-app.com. Our team reviews reports and may remove content, restrict accounts, or take other appropriate action. We reserve the right to remove any user-generated content at our sole discretion.

8. Intellectual Property

• The App, its design, code, and content are owned by XploreR and protected by intellectual property laws
• “XploreR” and associated logos are trademarks of XploreR
• You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: fitness for a particular purpose, uninterrupted or error-free operation, accuracy of GPS or location data, safety or accessibility of quest locations, or availability of the Service at all times.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, XPLORER SHALL NOT BE LIABLE FOR: any personal injury, property damage, or other harm arising from your use of the Service; any indirect, incidental, special, consequential, or punitive damages; any loss of data, profits, or goodwill; any damages arising from your use of location-based features; actions taken by other users, quest creators, or third parties; or GPS inaccuracies or location errors. Your use of the Service and participation in quests is entirely at your own risk.

11. Indemnification

You agree to indemnify and hold harmless XploreR, its directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, your violation of any applicable laws, content you create or upload, or any harm resulting from your gameplay activities.

12. Termination

• You may delete your account at any time: in the App under Settings → Account & Privacy → Delete Account, in your account settings on the website, or, if you can no longer sign in, by emailing privacy@xplorer-app.com from the address on the account. See the account-deletion page for what is deleted
• We may suspend or terminate your account if you violate these Terms
• Upon termination, your right to use the Service ceases immediately

13. Modifications

We reserve the right to modify these Terms at any time. Changes will be communicated by updating the “Last updated” date at the top and posting a notice in the App for material changes. Continued use of the Service after changes constitutes acceptance.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Belgium, without regard to conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of Belgium.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
